Interim maintenance payment

   Respected Sirs,   

               

           My Son has filed a Divorce case against her wife on the grounds of Cruelty and Unsoundmind.

      

         Meanwhile, the wife asked for Interim Maintenance which was awarded and now the husband

 is ready to pay the Interim Maintenance amount in full.

 

         Now the Wife doesnot respond properly to receive the Interim Maintenance amount.  Their Lawyer

also avoiding us to give details regarding the name on whose favour the Demand Draft should be taken.

Donot know why they (wife and her lawyer) refuse to give the details, may be to drag further the divorce case.

 

        One more problem is that she has given three names in the divoirce case.  (Ramya,  Priya,  and  Ramapriya).

Because of her multiple names, the husband is confused to take the DD on  what name?   In the court she has

admitted that she has three names.

 

           Now the questiions are:

          1.  The Demand Draft for IM to be taken on what name?

           2. If we donot  get the correct name, in that situation how can we make payment of the IM.?

 

        Please clarify.

As per the scenario that you've explained above one thing is clear that the opposite party is planning to create a new scene regarding the matter in order to cause more touble.

So, in such situation you can not obviously make any DD because the information is deceiving and thus, all efforts could go in vain. Henceforth, you must consult you're lawyer in the matter, and file an application stating the situation (i.e. reluctance of the opposite party to provide adequate and requisite information), upon the application the court will ask the party to provide you with all the details that are needed to proceed further with the maintenance payment.
