My name is Vinayak and I am from Bangalore.After a mutual consent divorce the custody of both my sons was with me and the mother opted for visitation.
Last month, after one weekend (post visitation) she tried to forcibly keep back both the boys but the elder one refused and returned. She has forcibly detained by second son.
he hasnt gone to school for the last one month now.
She had also filed for custody via a G&WC petition.we tried to reason with her that till such time an if at all the custody is reveresed the custody should come back to the father as per the mutual consent mediation agreement...but no luck.
The police is also of not much help as they say the case is already on court and it is a family issue and hence we either solve it amicably or let the court decide as it is a contempt of the court order.
Can I file any petition againt her on criminal lines as in simple terms it is an illegal detention against an existing court order.
