If wife do suicide...

My wife is little aggresive lady .

At present she is staying in my rented flat ( I am not staying there) if in anger/frustration she kills herself what issues I can face ( presently divorce case is in court).

In the event your wife commits suicide and in her suicidal note she mentions your name, there is no escape for you from abetment to suide. In case your wife has suicidal tendencies and in anger/frustration she takes a worng step, it could lead you to prison for several years without no fault of yours. Most of the aggreesive women in revenge take such steps to ruin their Husbands and his family.The best way is to compromise in life, as relations never die a natural death,  They r always murdered, either by Ego, or lack of communication or care." Its always better to win over an exisiting partner then divorcing the first one and looking for the next, who know the second one may be worse than the First one. More over in India the females (married women) are having an upper hand for 7 years under the prevention of dowry act 498A, wherein a women can ruin her hubby's life and his family  by lodging false complaint of dowry harassement; wherein most the Police takes action against the Boy and his family with investigating for year

You asked us everything in two sentence except telling us how old is your marriage which is most crucial to have said before us and now guess yourself if your presented scenario going to fall under below IPC section J

S. 306 IPC. Abetment of suicide

 

If any person commits suicide, whoever abets the commission of such suicide, shall be punished with imprisonment of either descripttion for a term which may extend to ten years, and shall also be liable to fine.

 

CLASSIFICATION OF OFFENCE

 

Punishment—Imprisonment for 10 years and fine—Cognizable—Non-bailable—Triable by Court of Session—Non-compoundable.


Comments

Abetment of attempt to commit suicide

(i) It has been held that once the offence of abatement of committing suicide is clearly made out against accused, despite the fact that specific charge under section 306 was not framed against accused, would not preclude court from convicting accused for offence found proved; Prema S. Rao v. Yadla Srinivasa Rao, AIR 2003 SC 11.

 

(ii) The basic constituents of an offence under section 306, are suicidal death and abetment thereof; Sangarabonia Sreenu v. State of Andhra Pradesh, (1997) 4 Supreme 214.

 

(iii) To attract the ingredients of abetment, the intention of the accused to aid or instigate or abet the deceased to commit suicide is necessary; Pallem Deniel Victoralions Victor Manter v. State of Andhra Pradesh, (1997) 1 Crimes 499 (AP).

 

Sec. 302 and Sec. 306 - Basic distinction

Two offences under section 302 and section 306 are of distinct and different categories; Sangarabonia Sreenu v. State of Andhra Pradesh, (1997) 4 Supreme 214.

 

Sentence

For offence under section 306 the sentence may extend to ten years. In case the husband is found to have harassed his wife to such an extent as to drive her to commit suicide, sentence of five years would be proper sentence for the crime with the amount of fine of Rs. 20000 to be paid to the parents of the deceased; Prema S. Rao v. Yadla Srinivasa Rao, AIR 2003 SC 11.


Suicide—Meaning of

The ‘suicide’ is stated to mean as the intentional killing of oneself.

As per Concise Oxford Dictionary, 9th Edition, p. 1393

A finding of suicide must be on evidence of intention. Every act of self destruction is, in common language described by the word ‘suicide’ provided it is an intentional act of a party knowing the probable consequence of what he is about. Suicide is never to be presumed. Intention is the essential legal ingredient.

As per Halsbury’s Laws of England, Fourth Edition, Ninth Volume, pg. 686.

I agree with views of Mr. vinod. One thing i suggest you is to say to your wife  "sorry" again and againor 100 times it will not make your dignity low but also increase your tolerance power then let go and give this problem to God

Tajobsindia ji,

It is 5+ years of desertion. After I filed divorce case just few days back she came in my rented flat and next day after her entering in flat I left the rented flat.

Now staying with my friends.

1)What will happen if she do suicide at my rented flat?

or

2) What will happen if she do suicide in her parents house?

Publicly never suggest THAT. Bechara samay ka mara will first contest till his bare bottom ups for next 4 - 5 years a case under S. 306 and then suppose he get conviction then 10 years of his so called YOUTH will be ideating behind prison doing RI and not SI as some possibilities.

Desertion track record of begum sahiba is not what interest me on subject matter of “wife’s suicide”. I thought you will tell us how many years both of you are married from!


Anyhow, coming to your wishes are horse thinking, you are now required to study umpteen citation on S. 306 IPC attentively whether she leaves this crowded planet from your rented place and or from her natal home and or from the famous Ridge Road of Delhi or even plunging into Hussain Sagar lake, you are still liable to plead your innocence under S. 306 IPC in absence of a strong criminal law Advocate to your side as any un-natural death of a begum sahiba in 7 years of marriage this Section of IPC is automatically put by yours truely IO uncle ji.


Best current bet is to please Lord Hanuman on HIS fav. weekday that SHE receives dudho nahao puto faloh till some safe remedy falls on your lap from these gender biased laws of the land.  


Observations: Also learn from my best friend here @ Zeeshan who now a days seems to be a passive LCI member on how he dramatically learnt most of the great Indian matrimonial magic after initially asking one too many questions in those early days and practically today I feel he is in control of most of his cases (not S. 306 IPC on him but several others is what I am hinting to you too to take cue from).

We both stayed together for 2.5 months  and from 5 + years we are not living together.

Try to handle the situation tactfully. You will be doomed if she commits suicide for any reason whatsoever leaving a suicide note blaming you.
