Hotel cheating / fraud

Hi,

Recently we have booked a hotel SV Residency in Ooty after going through the rooms photos and facilities.   We booked the rooms by full payment and it was a non-refundable booking as per website.  After reaching at hotel we found rooms were totally different from what was shown on website.  it was totally unhygenic, bad odour, no ventilation, very very dirty rooms and bathrooms. We were two families 6 adults and 2 kids, booked 2 rooms.  As we reach in night 9.30 pm, we didn't had any option available. we spend night and next day morning immediately checked out. 

We informed our conditon to makemytrip, but was of no use.  MMT replied stating hotel is dening to refund the amount.  

How can a proceed legally further.  I stay in hyderabad, hotel is in ooty.

Make my trip is not the authority which can provide you legal relief.

You should have resorted to police complaint or at least issue a legal notice demanding refund of the booking amount owing to the bad services and consequently you had to check out.

After that you can approach consumer redresal commission for relief of compensation and refund of money against deficiency in service as well as unfair trade practice

Is it possible to issue a legal notice from hyderabad ?  And also, do i need to visit ooty for consumer court case filing if any?

You can issue notice from Hyderabad to SV Residency Hotel Ooty but have to file complaint before Consumer Commission at Ooty.

Okay. for filing complaint and case proceedings do i need to be there personally?

You have to file the complaint case by online mode only.  You can take the assistance of an advocate having expertise in this field and file the complaint online, after the case is numbered, you may have to visit the consumer commission in person at least two to three hearings within which the case will be disposed. If you want to appear as party in person then you may have to follow the steps suggested above, or you can engage a local advocate who will take care of the case in your absence

File a consumer complaint through a local prudent lawyer. It can be filed from your residence as well u/s 34(2)(d) of the Consumer Protection Act, 2019

To my understanding, the complaint could be filed at the place where the complaiant resides or where the cause of action partly or wholly arose.
