I am working with an organisation as fixed term contract employee. I joined here on 12-01-2018 for one year contract ending on 11-01-2019. then this contract again got extended for one year and i got new one year contract extension letter.they are deducting gratuity amount from my salary every month and same is also mentioned in my salary slip. this gratuity amount is included in my CTC. could I got this gratuity amount if I resigned here before completion of 5 years. actually this query is bcoz I am not permanent employee.
Being contractual employee you will become eligible for the payment of gratuity on completion of 5 years of service, if continuing with the same employer. But, it is another wonder that your employer is deducting the amount from your salary in the name of gratuity.
yes they are deducting gratuity amount every month from salary and it shows in salary slip also. about contractual employee, I am fixed term contract employee. first they offer me one year contract then got extension for another one year and now they have given 6 months extension.. so how I will complete 5 year here? probability of completing 5 year is very less.
I think u dont understand about fixed term contract employee... and instead of understanding this u are getting irritated.. employer who offer fixed term contract for employee to them they don't give joining as on role employee.. u should understand about the practices for fixed term contract employee
Correct, I don't understand the word ON ROLE EMPLOYEE and I don't want to understand it. Because any employee whether regular or on contract remains on the ROLL of the employer's company. There also is a new phenomenon for me, where an employer deducts the gratuity amount from the employees like you. So better contact some local lawyer who is aware of such practice or the phenomenon.
