Which gratuity rules apply e.g; Payment of Gratuity Act, 1972?

We are an NGO, having our Gratuity Trust with LIC and deposit our yearly premium based on actuarial valuation done by LIC in the month of March.
So we would like to know under the Gratuity Payment Act and LIC, can an Employer pay an employee who serve us less than 5 years??
