gratuity

Hi Everyone!!

need advice on gratuity. I am completing 5 years of service on the 2nd May 2010. If i were to tender my resignation on the 7th April 2010 and am required to serve out 30 days of notice period which would mean my last working day in the organisation is the 7th May- would I be eligible for the gratuity?

is the last working day considered or the date of resignation considered for determining eligibility for gratuity. Please let me know.

Even though you have not worked for 5 years, you are still eligible for gratuity as in certain cases the labour courts have held for employees who have worked for more than 4 years being entitled to gratuity.
