Grandfathers property

Hello

My grandfather's property is undivided among his 6 children 3 males and 3 females. One of the youngest son has been looking after  and enjoying the property for 40 years after grandfathers death. I understand that he cannot claim complete right on the property as its undivided family property.

Now the other 5 members want their share. What legal options are available to stop the youngest son from enjoying the full undivided property. Also can the other 5 claim anything for not having received anything from the undiveded property ?

Thank you

Rajendra

The other 5 members have to file partition suit in court to get their share in said property.

Other 5 members file partition suit with separate possession along with future  mesne profits then they will get their share aswell as future illdings from property

Other sons and daughtes should issue notice to younger son of your grandfather and demand him to make partition of their father's property if he denies or not respond the notice then have to file suit for partition  and separate possession of property.

A pre suit notice can be issued by other five children of your deceased grandfather to the one now enjoying the property and demand amicable partition of property and separate possession of each individual share in the property.

If he fails to respond or cooperate then you can file a suit for partition to divide the property by metes and bounds and allot your legitimate share in the property with separate possession.

You can even demand mesne profits till the disposal of the suit proportionately.

File a suit for partition and possession of the subject property through a local prudent lawyer.

Please appreciate the fact that repitition of same query shall not serve any fruitful result to change opinion of experts who have already obliged you. Besides this, repitition of same query is absurd and ridiculous.

However, if you are dissatisfied with the obligation of experts, it is better to consult and engage a local prudent lawyer for proper analyses of facts/ documents, professional advise and necessary proceeding.
