I am a teacher worked in private school. school isrunby bank officers. school is affiliated to cbse board.
two years before i was suspended and dismissed for reciting secular prayer in the assembly. My dismissal order is signed by the correspondent of school. against that i went for appeal. appeallate authority as per cbse provision is five member committee. three members from school, one member from outside school and one member from cbse board as a advisor. as perprovisions of tamilnadu private schools act appeal has to be attended withinone month. if not reasons for delay shouldbe intimated to the affected persons. as per cca rules appeal mustbe closedwithin six months. both the rules were not followed. my appeal was not attended for the period of one year. I approached the court and as per courts order my appeal was disposed.
appeallate authority includes both cbse officer and school. since school comesunder cbse board should obey the cbse byelaw. school rule doesnot say anything about the appeal provision. I have sent my appeal letter to both cbse board and . school .mistakeisonthe part of school aswellas on the part of cbse board.
1.can i fileacriminal case on cbse board or appeallate authority (including cbse and school)
2. under what sec can i file the criminal case under sec166 or any other sec
3. under what sec can i file the writ asking for compensation
4.am i eligible to ask for compensation
