Fake 307 quashing

Hi friends,

There is a property disppute between my father and uncle. To put us under pressure, he has implicated my father and brothers (one works abroad and other a minor student)  in a fake 307 case by providing fake medical certificates and fake witnesses. Incidentally, the dates he has given are the ones at which both brothers were home for holidays.

At present, he has even encroached my dad's share of property which was agreed in the batwaranama however the Batwaranama is unregistered.

Father/brothers have already got anticipatory bail from state high court on grounds of High court acknowledging that it's a property dispute. We also recently learned that there is a good possibility of getting this case quashed from high court. It would be of real help if someone can throw light on below:

a) how feasible is it to get the 307 case quashed through state high court

b) how can we go about getting our property back from him (i.e. should we file for a fresh batwaranama or we should ask request the court to help us get our share mentioned in Batwaranama) - we dont mind any of two options, but which one would be better.
