1 The head of school had no legal authority to issue chargesheet to an employee 'A' 'but he issued. Which is stiil not decided upon even after a period of 4 years.
2 The same HOS fabricated false document against (A) in which he alleged false accusation that (A) has used caste based remarks against another employee (B) of SC community. This accusation is false as HOS had no evidence to corroborate the same.
3 The HOS created a detailed report and forwarded to to higher authority for stern departmental action against (A) . The departmentment even did not take this report as genuine one because on earlier two occasion (B) had filed similar complaint with SC/ST commission & parliment of INdia against (A) which proved false after inquiry.
4 The said (A) had earlier filed 2 court cases against (B) in some other matter in which (B) is surely to be convicted in the court. Therefore (B) conspired with HOS and got the false report created against (A).
My question is :
Whether is it a proper case for (A) to file crminal case against HOS u/s 166,167,218,182,120B, 499 & 500 of IPC for creating bogus chargesheet and SC issue related report to inflict injury upon (A).
Kindly advise with technical points and case law if possible.
