Ex parte order

Summon was given thru bailiff but party didn't accept ,can exparte order demanded



Quick Summary
If a party refuses to accept a summons served by a bailiff, this refusal can be reported by the process server. Based on this report, the court may proceed to issue an ex parte order. This means legal proceedings can commence even if the other party has not formally accepted the summons.

If the process server has mentioned in his report as refused to recieve then it is served and exparte proceedings can begin.

Yes, service of summons depends on process server repot, if opposite party refuse to accept summons and process server makes report in this regard then court may pass ex- parte order.
