Eviction process with amena

Hi,

Looking for clarification on possible actions taken by my tenant when we visit him to vacate with Amena

1. What to do if property is locked. Can we forcefully enter and keep his stuff outside.

Do we need take responsibility of stuff placed outside or leave it as such

2. Can he protest and engage in fights with us inspite of going with Amena

No, you can't  evict tenant forcefully a d without due process of law.

We are going with law process. The case has concluded and are going with Amena for eviction since he haven't honored court decision. Above questions are when we go with Amena

T. Kalaiselvan, Advocate (Advocate)     28 November 2024

It is an action on the basis of the orders passed by court in the execution petition.

The court Ameena knows the procedure hence you need not do anything except wait and watch the developments.

Once the premises is vacant the court Ameena will handover the keys as per court order.

You have repeated the same question in another thread of this forum today itself with different language.

Don't open new threads out of your anxiety, you can post subsequent questions in the same thread

Sure thanks for reply. So Amena can break open property and take the things out even if locked and will provide us the keys.

Do we need to take care of things till tenant picks up or leave it as such.

Dr. J C Vashista (Advocate )     29 November 2024

Let Court Bailiff / amena may proceed who is well trained  on the subject.

Why did you repeat same story again ?

P. Venu (Advocate)     03 December 2024

The responsibility in effecting the eviction vests with the Court. It is unnecessary for you to overreach.
