Error date of birth in passport

I have been issued a passport with my date of birth  printed  erroneously as 07/09/1972 instead of 07/09/1992. I have my brth certificate and SSLC mark sheet to prove that i was born in 07/09/1992. When i approached the Regional passport office, i was asked to get a court order for their mistake. So i stated them the circular issued in 2001 by ministry of external affairs and argued that a court order is unjust. 

They seemed to be least bothered anyway. So what should i do? I want to get my passport corrected for my job trails.

prepare an affidavit and give it to the magistrate. he will c the proof and give his seal on the affidavit. take it to the passport office. they will allow.

Is the declaration of a first class magistrate necessary as i have all the underlying documents under the same date of birth. If it is necessary then how to go about it and the formalities to do the task. Please also guide me on the steps and time required for the entire process.
