Epf and esi issue

We had fixed salary for one employee 862 per day. He had worked 25 days in last month. Gross Salary 21550/- . PF Share (ee) 2586. and he need ESI Benefit also. How I had to process ESI Limit is Max 21000/- .

Quick Summary
This discussion explores the complexities of processing EPF and ESI for employees paid a daily wage. It addresses how to calculate contributions based on a daily rate and monthly earnings, particularly when the gross salary approaches or exceeds the ESI limit. The conversation also touches upon the legal framework surrounding ESI eligibility and the implications for 'daily wagers'.

If he is not eligible for ESI benefits what prevents yo from rejecting his applicaiton for ESI.

You cannot act against the law, hence you may limit yourself within the provisions of law and not beyond that.

How does an employee's salary be fixed at per day and contribute for PF & ESI to be beneficiary, being a "daily wager" as per facts posted ?
