Ekhata

I am buying one villa which is having JD between landowner and developer. They have unregiatered supplimentantry agreement which is not registered. In supplimantry agreement each vill ownership mentioned .developer have sold almost all villa except few . Now they are not able to do ekhata of that villa . Is there any solution ?

Firstly the initial khata is to be obtained by the land owner, it is after that only the the registration of villa layout will be approved or permitted.

After that the buyer of villa has to take steps to obtain ekhata from BBMP.

Usually the Developer / landowner gives “parent Khata” (for entire layout). Individual villa Khata is NOT always transferred immediately.

After registration Khata transfer / e-Khata generation is typically buyer’s responsibility. This is called Mutation / Khata transfer into your name.

The agreement as well as supplementary agreement between the landlord and developer is incomplete document qua establishing title of the land where villas have been constructed and further transfer of title of subect / individual villia.

Show relevant documents to a local prudent lawyer for proper analyses of facts / documents and professional advise.
