Driver/Owner Death in accident. Will Insurance company pay apart from MACT claim.

Driver/Owner Death in accident. Will Insurance company pay apart from MACT claim. Accidental Car was Insured and was registered in the name of Partnership firm.

Partnership firm has two partner Father and Daughter.

Father with wife driving car and died in road accident, Vehicle Hit and Run case registered in FIR.

LH. of Father (Disease) are entitle for claim through MACT 

First question is ... who will pay ?

... Insurance company or DLSA (accident took place in Haryana Sonipat, Disease resides in Delhi,, FIR lodged in Sonipat Distt. Haryana.

 

Second Question : Will Insurance company pay compensation / claim amount to LH of Disease related to Vehicle Drivers Death as owner (Disease) was self driving the vehicle at time of accident. But in insurance no premium is paid separately for drive's death ( Remember car is Insured in company name) But Premium is paid for Paid Drivers Death.
