Domestic violance

Meri 1st March 2021 ko marriage hui hai, about 6mnths....marriage k baad se hi meri saas or mere husband mere uppar mentally torture kr rahi hai all time.....husband ne haat bhi uthaya hai mere uppar...mentally torture itna baad gya tha k mein suicide attampt bhi krne gyi thi 1din...is liye uss din hi mere maike k log mujhe apne ghar le k aa gye the Chandannagar....1mnth ho gya hai....me iss k baad apne husband se baat bhi krni chahi par kuch solve nhi karna chahte...contact hi nhi kr raha hai mujhse....ab mein kya karu...kuch suggest kariye plzzzzzz....

 the importance of the husband-wife relationship, and  couples should strengthen their bond and work on their relationship first before going further next step.U can use several modes of communication with your husband. AFter all he is your soul not others like in-laws.

Based on your circumstances, if the mental cruelty has been aggravated by in-laws and husband. You may seek divorce on the ground of cruelty as per section 13(ia) of the Hindu Marriage Act, 1955 as well as maintenance under section 125 of Criminal Procedure Code, 1973. When a wife is unable to maintain herself, she can claim maintenance from her husband as a matter of right.

Mental Cruelty is a lack of kindness that adversely affects the health of the person. Well, it is easy to determine the nature of physical cruelty but difficult to say about mental cruelty.

In Pravin Mehta v. Inderjeet Mehta, the court has defined mental cruelty as ‘the state of mind’. Some instances of cruelty are as follows:

False accusations of adultery or unchastity

Demand for dowry

Refusal to have marital intercourse/children

Impotency

Birth of a child (if pregnant without consent)

Drunkenness

A threat to commit suicide

Wife writing false complaints to an employer of the husband

Incompatibility of temperament

Irretrievable breakdown of a marriage
