divorce in which jurisdiction?

Dear Members,

                             Me and my wife are staying seperately for more than one and half years owing to 498a which she had implicated on me and my family. My humble question to you all that can I file a divorce ? What will be the ground of divorce? Whose jurisdiction I shall have to file the divorce?

Better don't file a divorce, since it would have an adverse effect on the case. Points to note:

1. She would be free to go and marry and you would be hung running around the courts.

2. Her point would become stronger that you don't want to keep her.

can I file a divorce ?    ---   YES OFCOURSE.

 

What will be the ground of divorce?     ---   GENERALLY CRUELTRY, DESERTATION. SOME OTHER GROUNDS ALSO THERE.

 

Whose jurisdiction I shall have to file the divorce? --  AT FAMILY COURT  if available at your area,  otherwise district court.  if you got married according to hindu rituals then under the hindu marriage act.
