Divorce

Sir, my brother in-law has file a case for divorce from my sister. We are also willing this.But any attempt to conclude the process as soon as possible they are not showing any interests.I have to plan second marriage of my sister as soon as possible. Sir, is there any possibility to go head with second marriage of my sister with pending divorce case. Because her in-laws are intensely delaying the process with aim to destroy her further life

Never tak such step .Getting married with second person while first marriage is not dissolved is offence and also not valid under Hindu marriage act and laws.Your sistr will not get entitled for any right from second marriage and even cant claim anything from first husband as well as second husaband as alimony and maintenance.So first get divorce and then procced for second marriage.Feel Free to call for further query.

Getting married for the second time during the subsistence of previous marriage will render the second marriage null and void and also will be termed as bigamy.  Wait for  the court's disposal of the pending MCD, do not show your urgency on this issue so that the opposite party will be taking an advantage utilising your weakness.  Remain calm and watch the developments.
