i want to ask same Q. in another way, a man who is married and living separate from his wife since 4 year (wants divorce), currently he wants to live -in -relationship with another girl, can he do so ?

better not to do, but legally it is no offence.
but if he marries that girl - it is punishable u/s 494 ipc.

provision of sec 494 & 497 contradicts.
only solution is to declare 'divorce' as personal liberty under art 21 of the coi.
then people will not go on live in. they first get divorce then marry the next.
