Desertion

My husband has walked out of our marriage 3 years ago. He has been paying towards my child's education and monthly maintenance regularly. He visits her occasionally. He doesnt want to work on our marriage and all my attempts of reconciliation have failed. Even from my parents and his parents have failed. He has recently given up his Indian Citizenship for a Gulf nationality. I am very tired emotionally and psycologically from this separation which has been forced upon me and wish to return to India with our daughter. My daughter also wants to live with me when i asked her of her choice. What case can i file against my husband in order to prevent him from bringing my daughter back to the gulf. I most certainly do not wish to file for divorce but, want full custody of my child since i am the one raising her up alone.

No need to file yourself..wait and see..what he does..Be bold and love your kid more than your husband .

You may file for divorce on the ground of desertion since he is living away for the past 3 years. If you manage to prove desertion on his part, it will help you get the custody of the child.

Rightly said, you can ask for divorce on the ground of desertion.
