in my Apartments, The MC and Treasurer has depleted FDs from Reserve Fund money without approval by owners. They've paid out expenses out of the FDs amount for Rs 1 crore.
What are the suitable actions against MC applicable.

Write a written complaint to the MC demanding:
Explanation for withdrawal of Reserve Fund FDs
Copy of resolutions authorising withdrawal
Copies of bank statements & ledger entries
Confirmation whether General Body approval was taken
This creates a record and forces them to respond in writing.

Thanks Sir. aa there's no resolutions for withdrawal,no Bank statement and no GB approval available. However it's qualified in the Auditor's Report and notes to financial for Last year.
Moreover , written queries sent to MC demanding explanation and show cause. They're not replying to the written queries.
In this case please advise.

Immediately convene special general body of the society as per rules, get account details, remove such MC, if found guilty of taking any such decision / manipulating / forging etc.

If you do not get any response then you may approach the Deputy Registrar with a complaint about this irregularity and seek its interention and further action against the wrong doers as per law in this connection.

If the Association is registered under AOA with the Registrar of Societies, the society's other members shall complain to the Registrar of Societies against the committee by registered post. Why did the members send a legal notice?

Registrar of Societies has no teeth to take any action against its office bearers. It is the Association through its members who may raise / settle their issue(s) / dispute(s) .
In case the dispute(s) are not resolved amicably (within association) they will have to move to civil / High court of jurisdiction.
