DECORUM Of LAW OR harassment ?

Report is lodged against accused, copy of report is provided to reporter but not to accused at the time of arrest.Why?

In court room special box is made for accused to make him feel in every hearing that, he is accused. While at least 10% are innocent. It seems very odd specially when accused is a senior citizen or a lady. Before the case is proved why he is put so in the box?

He is brought from jail to court hand cuffed without having criminal history? Why they are not classified as professional and first offender? They are kept in the same jail where the professional criminal and history sheeters are kept. why?

Prosecution is permitted to use ¼ th of full size paper but accused is directed to use full scape good quality paper. Why?

Prosecution is granted several adjournments years to years, but accused is granted only counted ?

News of conviction is published in several news papers but Innocent have been acquitted not. Why?

It is mental harassment and as well as inefficiency of judicial system.

Dear Arvind,

You have not stressed the social stigma attached with the accused person once the insulting (guilty till proven innocent syndrome) the tactics adopted and practised by khaki and God forbid the suffering of whole family enamating from proceeding at Police Station ending with jail term (during investigation and trial). Inability and helplessness of not understanding the law and procedure and watching sufferings, insecurity and victimization of the family (being made to live as if they are second class citizen). AND STILL DESPITE ALL THIS THE LIFE SEEMS TO GOES ON...

Mr.Aravind's comments are certainly golden words. First of all, like in USA and other developed countries, the accused should be made to sit alongwith their lawyers for easy comprehension of the proceedings of the case, they are charged with. But Police officers are allowed to sit alongwith the lawyers in Court Halls.The Accused Box should be done away with in our Court Halls. The accused shall be distributed free copies containing their legal rights and procedures in English/Local language. Procedures shall be same for the prosecution as well as the accused.

Thanks for this posting/thread.

It is realy painful to be accused for sesetive persons. We need to strenthen our Investigation agency, Unless there is strong evidence, no arrest should be made. Here mere naming anyone makes him accused. In an incidence, one lady lodged an FIR against a doctor for s*xual harrassment. The doctor commited suicide due to mental pressure. Later after investigation, the complain was found to be false one.
