Cyber crime

Dear Sir/Madam, I am Tax Practitioner, I got one company registration work from client..so that i asked one of the my friend who is chartered accountant to digitally sign the documents. instead of doing his sign he attached his boss digital sign and sent the documents to me.. my friend's boss filed a case on both of us for IT act 74, 66d and IPC 420, 120(b) sections of IPC. Please help me

Nothing to worry about this.

In the legal fight, your friend's BOSS won't be able to prove his claims as he shared his DSC with your friend.

Assuming your friend works under the BOSS, the BOSS himself did the mistake by sharing the DSC.

Yes sir, we both arrested and we were in prison for 10 Days..later we got the bail..my friend's boss always kept his DSC and clients DSC with my friend only..now he filed that my friend theft his DSC. This is happen only because of grudge..as my friend left from that job and started the practice..

Wait (till 4 years from the date of FIR) and see if chargesheet is filed.

If no chargesheet is filed in the said period, your case will be covered by the Limitation Act and filing chargsheet after that period will be void. Thus the case will have no merit for any proceeding. Because the court doesn't have time to entertain small issues as there are tons of serious cases pending at court because of this kind of small cases. For this reason, nowadays there are DLSA to resolve this kind of disputes.

But, if you want to be acquitted by the Court, better take Cyber Crime specialist and a skilled advocate (only to fight in court as the Cyber Crime specialist advice). Do not think that a talkative or so-called reputed lawyer can make you win this game in court. Because there are too little numbers of lawyers who are skilled in Cyber Technology. 

Cyber Crime is not all about the LAW, it's about knowledge and skill in Technology more than the LAW.
