Criminal revision dismissed by sessions court

Dear experts,

My brother had filed a complaint under 156 3 against me in a property issue which was dismissed by the JM. Thereafter, he filed a criminal revision in sessions court. The sessions court issued notice to me. However, before any arguements the judge has dismissed the application himself as he did not see any merit in the case whatsoever.

Can I file malicious prosecution intent against the complainant. What other options do I have.

Also, does the complainant still have any remedy. Can he approach the high court for revision, as 1 revision is already rejected.

yes u can file a case for malicious prosecution case, the complainent still can move to the high court  or can file a complaint case against you.

Dear,

Every person has right to file the case, if the lower court did not consider his view than move to higher court.  As well as you have also right to file a case against the complainant on account of malicious prosecution.
