Criminal case to remove encroachet

One week ago, an encroacher selling food items set up a small shop on the foot path, which is government land. But while doing business, he is also using our private land. I asked him to leave, but he is refusing to go. He seems to have political support of local councilors. Is it possible to file a criminal case to remove the encroacher?

Do you accept encroachment on your private land, if not, file a police complaint for tresspass.

You can lodge a criminal complaint with police for illegal encroachment and criminal trespass besides you can submit an application against him with the municipality for encroaching the govt land, putting up a roadside Shop illegally and creating nuisance to the neighborhood.

The encroacher, while using the footpath, is using your private land is objectionable, and you can file a complaint with the police in your area.  But nowadays, everywhere, either in cities and towns, some people are doing footpath business and it is very common.  But legally, it is objectionable, and to my best knowledge, while Mumbai and Delhi hawkers were doing footpath business, a case was filed, and the SCI issued some guidelines on footpath business.  But I do not know the case details.
