*यदि एक Party का लिखित जवाब का अवसर समाप्त हो जाये और वादी द्वारा अपना साक्ष्य शपथपत्र दाखिल करने के बाद..... क्या Opposite Party को जवाब दाखिल करने के लिए वादी का साक्ष्य शपथपत्र दिया जाना कानूनी नियमानुसार सही है या फिर नहीं...... यदि हाँ तो क्यूँ.. यदि ना तो किस नियम के मुताबिक...*

If the defendant has not filed the written statement, such allegations of facts shall be treated as admitted. The Court in this situation can either proceed to pronounce judgment on such admitted facts or may require the plaintiff, in spite of such admission, to prove such facts.

Thus, Defendant must file the Written Statement within the time period of not more than 120 days from the date of service of the summons, and thereafter upon the expiration of this period, the defendant will forfeit his right to file the written statement and the Court shall not allow the same to be taken on record
