Court marriage

Hello everyone.  I am in big problem can u please help me out ..

I was married on 2013. This was an arranged married. We had got divorced 2017 at family court kamrup guwahati. I also got divorce certificate at that time . But while shifting the house I lost my divorce certificate.

Now, 2024 I am going to do a court marriage. I don't even a case number. With whom I am having a court marriage,  I told them that I lost my divorce certificate.

Will the divorce certificate be asked for in court ?

Hi, it’s understandable that you’re worried, but don’t stress too much. Yes, the court will likely ask for proof of your previous divorce during your court marriage proceedings. Since you've lost your divorce certificate, you can apply for a certified copy from the Family Court where your divorce was granted. You don't need the case number—just provide your name, your ex-spouse's name, and the date or year of the divorce. It’s a straightforward process, and the court can help retrieve the records.

If you need any further assistance with this, feel free to reach out!

Such marriage, under the Special Marriage Act, is registered by the authority so authorised. Have you ascertained the extant procedure with the said authority? A missing document could always be made good through an affidavit.

Contact your lawyer /his clerkwho facilitated your divorce case, concerned court staff or  facilitation inquiry branch of the court.

However, it is not a legal issue.

You can visit the concerned court personally and file a copy application for certied copies of the divorce decree.

You can get the details of the case from court office itself.
