Regarding compassionate appointment scheme 2002 punjab

Riya father is police officer who died during his job. and after that her mother get his job . but now her mother is also died in 2021 not during her job but she is retired from service and died in 2021. now riya is alone and having no source of income. she is graduate. and there is health isssues too. she is not fit and she undergone surgery in the back. she applied for job of her father . she wrote letter to DGP also for compassionate job appointment but refused as they said that Riya is late to  apply  for job . she is late as  per them for 9 years and 8 months .so can she file a case in high court against department for a job with the help of medical  certificates as she has no source of income

DOPT OM [Para 3 of O.M.  No. 14014/3/2011-Estt(D) dated 26.07.2012]  10.  BELATED REQUESTS FOR COMPASSIONATE APPOINTMENT (a)  Ministries/Departments can consider requests for compassionate appointment even where the death or retirement on medical grounds of a Government servant took place long back, say five years or so. While considering such belated requests it should, however, be kept in view that the concept of compassionate appointment is largely related to the need for immediate assistance to the family of the Government servant in order to relieve it from economic distress. The very fact that the family has been able to manage somehow all these years should normally be taken as adequate proof that the family had some dependable means of subsistence. Therefore, examination of such cases would call for a great deal of circumspection. The decision to make appointment on compassionate grounds in such cases may, therefore, be taken only at the level of the Secretary of the Department/Ministry concerned. (b)  Whether a request for compassionate appointment is belated or not may be decided with reference to the date of death or retirement on medical ground of a Government servant and not the age of the applicant at the time of consideration. 

Therefore on the basis of above information, you may apply for the job

The application for compassionate job in this case is nothing but a wastage of time stationary and money.

 

Given facts indicate that she is perhaps a known earning daughter of two government servants in case she's unmarried and not employed anywhere or earning less than 9,000 rupees per month she is entitled to get the family patient of his father as well as mother.

 

Energy need to be directed to fruitful purpose of being added in family pension
