You need to apply to the concerned court for condonation of delay in curing the defect if there is provision for it. It is not the duration of delay but the reason behind delay matters most. You have to show that delay is not intentional and due to negligence but on account unavoidable circumstances. You also have to convince the court that there is no harm in condoning delay to other party as delay has not resulted in creation of right in favour of other party.
