Complaint

Whether a complainant in a criminal case be treated as a witness prior to taking cognizance of the case?

Witness for what and in which Case?

 

To the best of my knowledge, a Complaint is a one-sided version. Police after receipt of a complaint shall investigate and establish a crime and then it becomes a criminal case. The person who complained also shall be a Witness.

Yes, the Complainant can be called as a Witness by the Court before taking Cognizance when the case was instituted as a Private Complaint.

When it is a Police complaint before taking Cognizance Court will not call the Complainant as a Witness.
