Complainant close the evidence stage in dishonor of cheque case

Hi 

What I do 

Dishonor of cheque case 

Court stage is evidence 

Accused  advocate take a cross of bank manager  but bank advocate close the stage by giving purshis to close evidence from complainants side 

I am accused side advocate  and I want to take cross of bank manager

What to do

Please help

You can file a petition to reopen and recall the witness that was closed without giving you an opportunity to cross examine him.

The bank panel advocate cannot represent his bank in the private cheque bounce criminal complaint case.

He has no locus standi to file any petition on behalf of the bank.

If your petition to reopen is not allowed then you can file a revision petition before district court.

Court can't. forfeit your right to cross examin complainant's witness without giving you an opportunity to cross examin witness.File an application under sec 311 Cr.P.C if case is old or under sec 348 BNSS if case is new one to re call the witness for cross examination.

Are you sure that evidence is close.

 

The bank mnager is prosecution of defence witness?

Case history reveals that the accused and his advocate have been wilfully delaying the evidence. To my understanding, the complainant has filed only a pursis to close evidence in cross-examination; court has not given any decision.

It is open to the accused and his advcate to expedite the cross examination.
