Company promised replacement unit..but does not seem so. consumer law

Respected Sir/Madam,

I bought a product which during warranty period malfunctioned. I returned it to the company for warranty claim. They did nothing for over 30 days.

Then I sent a formal letter demanding refund within 15 days and if not received I mentioned that I will escalate to consumer court.

They wrote an email that I will be receiving a replacement unit back. But they are actually not doing it.

They do not respond to emails/phone etc.

I have given then 15 days’ time to refund. Now what are my options? Should I trust them that they will indeed provide a replacement unit? Or irrespective after 15 days if even replacement unit is not received approach consumer court?

I asked them to share the dispatch details, but they are not responding at all.

Hi

You have already given sufficient time for refund or replacement. The company’s failure to act or respond amounts to deficiency in service under the Consumer Protection Act, 2019. 

You may now proceed to send a legal notice demanding refund and compensation for mental agony and inconvenience. If they still fail to comply, you can file a complaint before the District Consumer Commission seeking refund, compensation, and costs.

Yes.  You can approach the District Consumer Commission for a complaint regarding a deficiency in service.

Company is bound to refund you cost of defective product in warranty period or it's replacement. You need not to send notice again to Company as you have already sent to them File complaint before Consumer Commission and claim refund of cost of production along with compensation towards mental and physical agony.

You can approach consumer commission after the deadline if the company has not complied with the demands made.
