Choice division of property

There are four legal heirs and the property is divided into four parts. The property has only one side open. How to decide which part to go to which one . Elder is sister, next all three brothers. There is dispute over who will get front two parts and who will get back to parts. What court will decide? Please elaborate.

In such circumstances the property (which you did not mention) shall be partitioned in terms of Partition Act, 1893.

T. Kalaiselvan, Advocate (Advocate)     07 March 2026

The court may divide the property either on the basis of the report of Advocate commissioner or if the parties don't agree to the court recommendation then the court may bring the property for sale and distribute the sale consideration amount proportionately as per the provisions of personal law.
