Cheque bounce

Dear Sir/Madam Iam having a cheque bounce case and Cheating case against me filed by my father. Please suggest me how can I renew my passport. It is mandatory as Iam a seaman.

You can apply for renewal of passport by furnishing the pending criminal case details, if the passport authority refuse to renew then you can file an application before the same magistrate court seeking an order to the concerned authorities to renew the passport at least for one year.

If a criminal case is pending (like cheque bounce under Negotiable Instruments Act, 1881 and cheating under Indian Penal Code), you can still renew your passport, but with conditions:

1. Permission from Court (Mandatory)

Apply to the trial court where your case is pending.

File a petition seeking permission to renew/reissue passport.

Mention your profession (seaman) and necessity of travel.

Court may allow with conditions (bond, undertaking, etc.).

2. Apply under “Pending Criminal Case” Category

While applying through Passport Seva:

Select: “Criminal proceedings pending”

Upload/submit court order permitting passport issuance

3. Limited Validity Passport

Passport is usually issued for 1 year (or limited period), not full 10 years.

You may need renewal again based on court directions.

4. Police Verification

Police will verify case details; cooperate fully.

5. Important

Without court permission, passport authority may reject or hold your application.

Practical Tip (Very Important)

Since your case is filed by your father:

Try to settle the matter (if possible), as it will simplify future renewals and travel permissions.
