I was convicted by a woman on 29.01.2010 alleging misbehavior. I was arrested under section 354 of IPC and was released on bail same day. chargesheet was registered in April 2010. Since than I did not make my presence in the court of Dehradun. Now the lady wants to wityhdraw the case. Whether the matters under section 354 are compoundable. What may be procedure?? next date of hearing before JCM Dehradun is 7.9.2013.

u have used the word convicted, it has a different meaning in law, u have been charged by a women. coming back to ur query for sec 354, outraging modesty of a woman using assault or criminal force, u can be convicted up to 2 years, offence is cognisable, bailable,non compoundable.if she really wants to withdraw the case she has to file petition under 257 crpc , since it is a non compundable ,and triable by a magistrate court , the court will take a call on this.
