Case not alloted to court since 2023

A WP filed in 2023 by a CHS in Mumbai is stuck as registry is not allotting the case to Court though objection raised are cleared. Unfortunately the lawyer is not responding to query though collected hefty fees.

What's the ready? Please guide. TIA

To address the issue of your Writ Petition (WP) filed in 2023 being stuck due to the registry not allotting the case to court, despite cleared objections, consider the following steps: - *Follow up with the registry*: Visit the registry and inquire about the status of your case. Provide them with a copy of the cleared objections to ensure they have the necessary documentation. - *Seek assistance from another lawyer*: Since your current lawyer is unresponsive, consider consulting with another lawyer who can guide you through the process and help you navigate the court system. - *File a petition for early hearing*: If your case is stuck due to the registry's delay, you can file a petition for an early hearing, citing the reasons for the urgency. - *Approach the court administration*: If the registry is unresponsive, you can approach the court administration, such as the Registrar or the Principal Judge, to seek their intervention in expediting the allocation of your case. - *Consider filing a complaint against the lawyer*: If you feel that your lawyer has not provided satisfactory services, you can file a complaint with the Bar Council of India or the State Bar Council. Additionally, you can explore online resources, such as the Supreme Court's website or the Bombay High Court's website, to understand the procedures and rules governing WP filings and case allocation.¹

If the court is not bringing the case in list then your lawyer cannot do anything about it.

When did you comply with the rectifications that were notified? 

If your advocate is not responsive then you may even change the lawyer by obtaining NOC from the current lawyer.

You must approach the Registrar or the Chief Justice of Bombay High Court. Consult another lawyer for guidance, before approaching the Registrar or the Chief Justice.

Go to the registry of HC and ask them to list the WP  at the earliest in court  for  hearing as all objections are cleared. Moreover, ask your lawyer to conduct your case properly as he has taken hefty fee and  thus he is also liable to conduct your case.

Kindly move a precipe before appropriate court room of High Court
dont wait for registries direction
