Can a financially independent lady suffering from a toxic matrimonial relationship be legally barred from shifting to an old-age home?

If she is a senior citizen, and may shift to an old-age home.
T. Kalaiselvan, Advocate (Advocate) 13 October 2025
a financially independent woman suffering in a toxic matrimonial relationship cannot be legally barred from claiming maintenance solely due to her income.
While her financial status is a factor the court considers, recent judgments emphasize that the purpose of maintenance extends beyond mere survival to ensuring a dignified life and a similar standard of living as during the marriage.
Varikoujs courts have established several principles that protect a wife's right to maintenance even if she is financially independent.
Under Section 125(4) of the Code of Criminal Procedure, a wife can be denied maintenance if she refuses to live with her husband "without sufficient reason." Toxic behavior and abuse are recognized by courts as just and sufficient reasons for a wife to live separately.

Wife cannot be debarred from maintenance despite the fact she is financially independant.
Shifting to old-age home cannot be thrust upon the lady if she has sore relation with her husband/ in-laws. She should / must claim relief(s) under section 18 to 23 of the Protection of Women from Domestic Violence Act, 2005 through a local prudent lawyer.
