Caeveat response

Can you please help me? A respondent has filed a caeveat requiring a Central Govt Dept requiring that (in case the Dept intended to file an appeal against Hon'ble CAT's order) he may be informed prior to the Dept filing a Writ Pettion against the order passed by the Hon'ble CAT, which was in favour of the respondent. The dept, being quasi judicial in nature, is it binding for the dept to respond to the caveat?

yes, you have to notice the caveator, through court before your first hearing to accept the case for sumning.

which was in favour of the respondent.

 

---   yes this is the actual purpose of a caveat. it is an interim system. it protects the interest of the wining party against the interim order.
