Ancestor property

 

           My Name is S Nalina Devi and my age is 42. Myself and my younger brother aged 40 are the real legal heir of my mother. My mother married my father on 06.09.1968. And my mother became lunatic and got divorced on 08.03.1977. My mother stayed in her younger brother’s residence. Until her death. Both of us (Myself & My Brother) are under the custody of my father.

My mother and her younger brother are the real legal heir of their father. Their father died in 1960. Their ancestor properties were awarded to younger brother in absence of his father on 03.09.1974. through a registered partition deed. My uncle sold out some properties and jewels of my mother including mangale suture etc., for his development of his business. My mother died on 13.12.2011.

Whether we have legal rights over the ancestor property as well as movable property of 60 sovereign Jewels owned by my mother. Can we approach the court of law? Percentage of share can be indicated. Please guide us.

Things Happened as Follows:-

Marriage of my Mother Conducted On : 06.09.1968.

1st Female Child born On         : 14.07.1970.

2nd Male Child born On          : 06.06.1972.

Ancestor Property Awarded to My Uncle

 through Registered Partition deed on : 03.09.1974.

Divorce between my mother & father on         : 08.03.1977.

Mother died on                          : 13.12.2011.

Mother’s Body was cremated by My Brother On : 14.12.2011.
