Greetings,

A Spouse can refuse to pay alimony in certain cases. However, it totally depends upon the facts of the case.

Alimony can be avoided on the basis of the following factors-

  1. Spouse was Adulterous.
  2. Prove they don’t need it.
  3. Prove you can’t maintain yourself.
  4. A sustainable source of income is a factor with which one can avoid paying alimony as the main purpose of alimony is to provide financial assistance so that the other person can maintain themselves.
  5. If the husband is remarried and has to maintain the other wife with a negligible source of income.
  6. The husband can refuse to pay alimony if the wife remarries.
