Can advocate demand fee as percentage of  subject matter of the case

No, Advocates can not charge fee on basis of percentage  of results, it is illegal.

Such demand is unlawful. However, in certain cases, such practice is prevalent.

This is a case of illegal mining by the  adjacent property owner because of that  the other property owner faced serious situations of soil erosion so he approached an advocate to file a petition to stop and  to have an injunction  during the petiod of the case the filing advocate  avoid vakalathama then the new advocate entered in this case he was not interested in this case. And was repeatedly absent in the court. Due to this the plaintiff and respondents reached in a settlement as a result of it  the respondents agreed to purchase the property with compensation and sale consideration. This act knowing by the advocate he demands 10 percentage of the settlement amount. But he already received Rs. 30000 in different times through on line. How will deal this issue

I opine that the said advocate has not taken the case to file in a civil court.  But he agreed to an amicable settlement between both parties.

The demand is illegal and amounts to professional misconduct. You need not pay. You have the option to complain to the Bar council.

You may lodge a criminal complaint against the advocate for extortion and other offences besides submitting a complaint in the bar council of your state and in the bar association where the advocate has registered himself for necessary action

There is no straight jacket formula for charging professional fees by an advocate,

Theoritically it cannot be on commission basis, however, practically it differs.
