Suggestions & advice is required for the below mentioned case:
My maternal grand parents died in 2003 & 2009 respectively & now my maternal unkle have filed a case for the grant of succession certificate against his siblings. My maternal grand parents have 7 childrens 2 sons & 5 daughters. My maternal unkle have filed a case against all the 6 siblings for the grant of succession certificate, no body wants to give him a sucession certificate as he haven't took care of his parents for whole life and avoided them all the time even when they were serious and hospatalised & only the daughters use to take care of their parents.
My maternal grand parents resided in the first floor of a property in which ground floor s occupied by my maternal unckle. the property was originally in the name of my maternal grandfather, but my maternal unkle prepared a gift deed & got it signed by my maternal grand father. This happened a long time ago (more than 20 yrs), & the issue was never been spoken by my maternal grand parents because of fear of defamation in relatives & society.
After the death of my maternal grand father in 2003 & maternal grand mother in 2009, my maternal unkle have filed a case for the grant of sucesion certificate demanding the details of belongings of my maternal grandparents in 2011. regarding this on behalf of my mother who is one of the defendant I seek your advise & suggestions to better proceed with this case. I want clarifications & your suggestions on few points that will make a clear image about this case in our mind:
1 - Do all the defendants require to file separate replies/cases, in reply to the case filed my maternal unkle?
2 - How can all the defendants ask for the grant of sucession certificate?
3 - Can all the defendants claim a share(as they all are equal sucessors) in the property in which a gift deed is made & signed fraduently in the name of my unckle years ago. (property as mentioned earlier was originally in the name of my maternal grand father)?
4 - What can be done to claim the property & also prevent it from sale to any other party as presently my maternal unkle is in posession of the property?
5- What preventive measure can be taken for prevention from future fradulent claims by my maternal uncle that also creates lots of defamation in society?
