Additional square feet available in posession than in paper

Hi Legal experts,

I am purchasing a property under BBMP in Bangalore, karnataka where the owner is in posession of 250 square feet of additional land at the backside of the scheduled property. As there is a huge apartment at the back of my property with a compound wall beyond this margin land, there would be no access to this addtitional margin land to anyone else beyond me. Now is it preferred to mention in the sale deed that the current owner hand overs this additional marginal land which is in his posession till now to me. Is it legally valid?

Also including this marginal land the overall schedule property would be retangular in shape and excludin this marginal land, the schedule property would be cross at the back side. Since no one else has access to this marginal land, extend my construction into this marginal land as well?
