Ad interim injunction

  • Is ad interim injunction in partition suit for share involving will ( unregistered ) given only after hearing both appellant and defendent?
  • in case ex parte ad interim injunction is given, is it possible to get it removed by the defendent and sell the property?
  • It is said that after selling the property, the court gives order to keep the share ( for which the appellant has filed suit ) amount  ( not the whole amount ) in the court as a deposit so that if the appellant wins he will get it.  is it true?

It  will be difficult to give a proper opinion without seeing the court order in this regard.  The details furnished by you are incomplete or improper/contradictory,hence you are advised to take a second opinion from a different lawyer locally if your lawyer is not responding properly.

Is there a provision for the defendent to request the court to give permission to him to sell the suit property after the ad interim injunction is given in favor of the petitioner / appellant in partition suit for share involving will?
