I require your expert opinions and help in regard to an accident my aunt met.
My aunt ,residing at Raipur/Chattisgarh, met with an accident on 3rd Aug 2012. She was crossing the road when two girls riding Honda Activa hit her.
My aunt has been battleing for life since then. Her head hit the road divider due to the impact and she immediately went into coma due to 1) multiple clots and 2) brain moving by 8mm from its original position.
Its been 19 days today since the accident. She is still in unconscious state.Has not opened her eyes and is dependent on external ventillation.
She is 58 years old and does not have any mediclaim. Also, financially they are not well-off.
On an average. everyday hospital expense is around Rs10k.
On the legal aspect:
1. Eyewitnesses have noted the Activa number.
2. Eyewitnesses also claim that girls were driving pretty fast due to which accident happened.
3. FIR has been lodged with the police (I'am not sure of IPC sections)
Now, your help is required for me to understand
1. What legal procedure do we follow?
2. Does the scooter comprehensive insurance cover her medical bills?
3. How do we ensure girls side pay all my aunts medical bills ( which has touched 2L today)?
Any other suggestions / ideas/help would be highly appreciated.
