Misconducts are tobe established thru due disciplinary proceeding as per rules of organisation and the said rule prescribe on time-line for punishment imposition. All misconduct need not to end in termination. So, the discipline rules of department will have explicit answer to query.

Any action for miscoduct to be issued with notice and the process of enquiry to be conducte and after oral enquiry pnishment could be enforced. You have not stated the stage of disciplinary action.
