Selling flat

I have a flat in Cooperative housing society in Mumbai. The flat is in joint name. My husband and me are the share holders. My husband died last year. Before dying he had nominated both our sons as 50-50 % nominee.

Now I want to sell flat because I am in financial need. One of my son is giving the NOC to transfer the flat in my name and he does not have any objectionin me selling the flat but the other son who is in abroad is not giving NOC. I am willing to give him his share but he is not cooperating with the NOC.

Will I not be able to sell the flat at all. Is there any way? I am willing to give him his share.

The proposal is good.But think of a way for getting a formal written concurrence from your son who is now not in India.With out an authorisation,you will be getting only a bad name to a lovely Mumbai.Consult some one who is nearer to your place of stay and try for authorisation leeter from a son who is abroad as on date.with best wishes from lakshman2048@gmail.com
