498_final stage (Professional)     27 August 2014

498a is delayed..judge does not come to the court

498a is running from last  2 years in Ghaziabad. Judge is mostly absent in the court. I feel the Judge is incompetent.


Can you tell me what can I do so that at least I get short dates. This time they gave me a date after 3 months?


Kindly advice.

Absence of judge on date does not mean that he is incompetent.

 

Also, w.r.t. early hearing dates, you can move High Court for speedy trial. A point to be noted is that in Allahabad High Court, the decision on Speedy Trial is taking upto 2 years. :(
